Suspect, 20, faces trial in assault on girl, 14

NOBLESVILLE, Ind. -- An illegal immigrant identified as one of several attackers in the gang rape of a 14-year-old girl is to go on trial this week.

Miguel Gutierrez, 20, is charged with two counts of rape and is one of two people arrested in the case.

Other suspects have not been located, said Hamilton County Deputy Prosecutor Stephanie Smith.
The trial is set for Tuesday in Hamilton Circuit Court.

According to court documents, the rapes occurred in July 2006, when the victim and a friend accepted a boy's invitation to a neighboring home in the 10700 block of E. 166th St.

Once there, she told authorities, the two girls drank alcohol in the company of four other Hispanic males. *snip*

A sworn statement of evidence from Hamilton County sheriff's investigator Kija Ireland says the girl was attacked when the boy forced her behind the house and took off her pants after she fell and hit her head trying to get away.

"(She) stated she heard what she believed to be belts being unbuckled then felt people having sex with her," said Ireland's statement. "During this time, the male subjects were speaking in only Spanish and she could not understand what was being said."

The boy, 16-year-old Eleazar Renteria, is accused of holding the girl down while she was raped by at least two others, including Gutierrez. Renteria faces adult charges of rape, criminal confinement, sexual battery and battery.

After running from the three to find her drunk friend, Ireland said, Gutierrez grabbed the girl again, took her to a truck and raped her a second time.
