Napolitano thought state immigration law applied to smugglers

PHOENIX Governor Janet Napolitano says that when she signed Arizona's immigrant smuggling law last year, she hoped it would be used against the people who get paid to sneak people across the border. But Napolitano declined to say whether the law would apply to the immigrants who pay smugglers to bring them across the border.

Maricopa County Attorney Andrew Thomas has issued a legal opinion saying the customers of immigrant smugglers can be charged as coconspirators under that law because they are assisting in committing a crime.

That legal position was used this week in a Maricopa County case in which 48 immigrants face charges of conspiring to smuggle people. Their alleged smuggler also was charged with smuggling.

Napolitano says the courts will eventually decide whether the customers of smugglers can be charged with conspiring with smugglers.

She says the purpose of the bill was to charge immigrant smugglers.
